1) About Us

If you are a consumer residing in the EU/EEA/UK, mandatory consumer protection rules in your country of residence apply in addition to Austrian law (see Section 20).
2) Scope & Acceptance
These Terms govern your use of the Site and purchases made through it. By accessing the Site or placing an order, you accept these Terms. Please also review our Privacy Policy, Cookie Policy, and Accessibility Statement.
3) Eligibility
The Site offers content suitable for children, teenagers and adults; however, purchases may only be made by adults (18+) or by minors with verifiable parental/guardian consent. By placing an order you confirm you meet this requirement.
4) Products & Services
We offer physical goods (often produced on demand via third-party fulfillment, e.g., Printify) and may offer digital content from time to time. Product images are illustrative; minor variations in color/placement may occur due to device settings and print-on-demand processes.
5) Prices, Taxes & Currencies
- Prices are shown in the currency indicated at checkout and include applicable VAT/sales tax where required, unless stated otherwise.
- Shipping costs, if any, are displayed separately during checkout.
- International orders may be subject to customs, duties, or import taxes payable by you.
6) Orders & Contract Formation
- Placing products in the shopping cart does not create a contract. Your order is an offer to buy.
- The contract is formed when we send an order confirmation email or when we dispatch the items, whichever occurs first.
- If a product is unavailable, we will notify you and cancel or refund as applicable.
- We may refuse orders (e.g., suspected fraud, pricing/stock errors) acting reasonably.
7) Payments
We accept secure payments via Stripe and PayPal. Your card data is processed directly by those providers; we do not store full payment details. Your bank or payment provider may apply currency conversion or fees outside our control.
8) Shipping & Delivery
- We ship to the countries offered at checkout. Delivery timelines shown are estimates; actual times depend on carrier and destination.
- Risk of loss passes upon delivery to your address or designated pickup point. Please check tracking information provided, if available.
- If a package is returned due to incorrect address or failure to collect, we can reship (additional shipping fees may apply) or refund the product price (less shipping) according to your statutory rights.
9) Right of Withdrawal for Consumers (EU/EEA)
If you are a consumer in the EU/EEA, you have a 14-day withdrawal period from the day you (or a person you designate) receive the goods, without giving any reason.
Effects of withdrawal: We will refund all payments received from you for the returned goods, including standard delivery costs (if charged), no later than 14 days from the day we receive the goods back or you provide evidence of having sent them back, whichever is earlier. We will use the same means of payment you used, unless you agree otherwise. You bear the direct cost of returning the goods unless required otherwise by applicable law.
Exceptions: The right of withdrawal does not apply to (non-exhaustive list):
- Goods made to your specifications or clearly personalized (including custom print-on-demand items with personalization).
- Sealed goods not suitable for return due to health protection or hygiene reasons if unsealed after delivery.
- Digital content supplied other than on a tangible medium once download/streaming has begun with your prior express consent and acknowledgment of loss of the right of withdrawal.
How to exercise: Inform us by a clear statement (e.g., email) to info@rubijuarez.com. You may (but are not obliged to) use the Model Withdrawal Form in Section 23. Please contact us for the return address and instructions before sending any items back.
10) Returns, Exchanges & Refunds
- For non-personalized goods, return items in original condition (unworn/unused, with tags, and in original packaging where possible).
- For damaged, defective, or incorrect items, contact us promptly with photos; we will arrange a replacement or refund according to statutory rights.
- Refunds are processed to the original payment method after inspection. Shipping costs are non-refundable except where legally required or where we made an error.
11) Statutory Warranty & Conformity
Your statutory rights under applicable consumer law remain unaffected, including legal guarantees on conformity for goods (and, where applicable, for digital content/services). If an item is defective or lacks conformity, contact us so we can repair, replace, or refund in accordance with the law.
12) Accounts & Security
- You are responsible for keeping your login credentials confidential and for all activities under your account.
- We may suspend or terminate accounts for breach of these Terms or suspected misuse, with prior notice when reasonable.
13) User Content & Reviews
By posting reviews, comments, or other content, you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, and display such content for Site operation and marketing, to the extent permitted by law. Do not submit unlawful, harmful, or infringing content.
14) Intellectual Property
All Site content (text, graphics, logos, images, designs) is owned by or licensed to us and protected by intellectual property laws. You may not copy, distribute, or create derivative works without our prior written consent, except as allowed by mandatory law.
15) Promotions & Discount Codes
Promotions are subject to specific terms. Discount codes are personal, time-limited, and non-transferable unless stated otherwise. We may cancel a promotion in the event of error, abuse, or circumstances beyond our control.
16) Third-Party Services
We integrate third-party services such as WooCommerce (storefront), Printify (production/fulfillment), Stripe and PayPal (payments), Brevo (newsletter), CookieYes (consent management), and Google Analytics (analytics). Their terms and privacy practices apply when you use their features. We are not responsible for third-party outages or policy changes.

18) Privacy
Your personal data is processed according to our Privacy Policy and cookie choices via Cookie Policy. You can revisit preferences via the “Manage Cookies” link in the footer.
19) Liability
Nothing in these Terms limits liability where it cannot be limited under applicable law (e.g., fraud, death or personal injury caused by negligence). Subject to that, we shall not be liable for (i) losses not caused by our breach; (ii) business losses (including lost profits, revenue, contracts, data, or goodwill) where you act as a consumer; (iii) delays or failures due to events beyond our reasonable control.
20) Governing Law & Disputes
These Terms are governed by Austrian law, without prejudice to mandatory consumer protection provisions of your country of residence if you are a consumer in the EU/EEA/UK. You may bring claims in the courts of Austria or in the courts of your habitual residence as provided by applicable law.

21) Changes to These Terms
We may update these Terms to reflect changes in our services or legal requirements. Material changes will be announced on the Site with reasonable notice. The updated Terms apply from the date indicated above.
